To deal with ‘problem 1 and 4’, I submitted a complaint to the Cat A section. Surprisingly, I encountered no resistance; we got a deferrment of around a month and the cut of date, duplicate report was removed from the dossier.
Problem 2 and 3 could be dealt with in the representations; that left problem 5, which I’ll refer to as the ‘threat’ information report (IR); this required a little more thought and creativity.
There were 2 aspects to the ‘threat’ IR; firstly, I knew who the author of the IR was – this could be dealt with through Care UK (more of this in a few blogs time); secondly, the prison had put this IR on my security file – in other words, they had processed tthis inaccurate personal data and were now in breach of the Data Protection Act 2018. Before I could challenge this IR, I had to do a significant amount of research into the legislation, the law and take legal advice.
