Heart Attack and Handcuffs (civil case)
Let’s try and fill in the last few months: after literally scores of letters trying to find an expert who would take instructions from a prisoner litigant in person (there were a couple but they were asking a ludicrous amount of money), I found a solicitor and barrister who, finally, obtained an expert report on the heart attack part to my civil claim. Unfortunately, it wasn’t helpful…
In layman’s terms: I had a partial blockage heart attack. Nauseating pain but not serious enough to warrant NICE guidelines on treatment times. Plus, not enough damage to my heart to link to the delay in accessing hospital treatment.
So a chunk of my heart attack case had to be removed by the court (summary judgement ). The judge also removed my Article 2 and 3 claims. This still left the 1 hour delay and pain, and, the injury and pain from the handcuffs.
I have subsequently, appealed the decision on the Article 2and 3 claims, so the trial date is yet to be set.
